Nevada mold rules for renting and selling

Nevada mold rules for renting and selling come from two places, the state seller disclosure form that asks about mold by name, and the landlord tenant law that requires a habitable home.

Section 1.0Selling. The disclosure form asks about mold

Nevada's Seller's Real Property Disclosure Form 547 has a Fungi or Mold line that asks about any previous or current fungus or mold1. It also asks about moisture conditions and water damage2, drainage, flooding and water seepage3, and problems with the roof4. The form says Nevada law requires a seller of residential property to disclose known conditions that materially affect the value or use of the home in an adverse way5.

Section 2.0Selling. Timing and what you did not know

NRS 113.130 says the seller must complete the form and serve it on the buyer or the buyer's agent at least 10 days before the property is conveyed6. NRS 113.140 says a seller does not have to disclose a defect the seller is not aware of7. Records of a past leak and its repair are worth keeping for exactly that form.

Section 3.0Renting. The habitable home standard

The state landlord tenant law, NRS 118A, does not use the word mold. What it does say is that a landlord must keep a dwelling habitable at all times8. A unit is not habitable if it substantially lacks effective waterproofing and weather protection of the roof and exterior walls, including windows and doors9, or if it violates housing or health codes about health, safety, sanitation or fitness10.

Section 4.0Renting. Notice and 14 days

NRS 118A.355 says the tenant gives the landlord written notice of each failure, and the landlord has 14 days after receipt to fix it or use best efforts11. If a material failure is not fixed in time, the section lets the tenant end the agreement, recover actual damages, ask the court for relief or withhold rent as it describes12. It does not cover a condition the tenant caused13.

Section 5.0What the health district will and will not do

The Southern Nevada Health District says it has no enforcement jurisdiction over rental housing and does not respond to landlord and tenant issues14. It lists mold among non essential complaints15. It tells tenants to send a dated letter asking for repairs under NRS 118A by certified mail with a return receipt16, and says a non essential problem such as mold should be fixed, or satisfactory progress made, within 14 business days of the landlord receiving it17. After that, the tenant can start civil proceedings18. SNHD points tenants to the UNLV School of Public Health Landlord Tenant Hotline at (702) 895-1971 and Nevada Legal Services at (702) 386-040419.

Section 6.0Where we fit

Legal questions belong with the hotline above or a lawyer. What we can give a seller, buyer, tenant or landlord is a written record of where the water was, how much material was affected and what was done. EPA tells renters to report leaks and moisture to the owner or manager right away20. Call or text (702) 728-4493.
